Why Do Some People
Need a Guardian?

In certain circumstances, individuals may require the support of a guardian or guardian advocate to make decisions on their behalf.

Guardianships can be voluntary or involuntary, with limited or plenary arrangements. The court selects a guardian and ensures the well-being of the person under guardianship. Florida laws govern the process and define the responsibilities of guardians, attorneys, and the court.

Here are some reasons why someone may need a guardian and the benefits it can bring:

Incapacity to Make Sound Judgments

When an adult is unable to make sound decisions due to cognitive or physical limitations, a court can appoint a guardian. This guardian acts as a trusted decision-maker, ensuring that the person's best interests are protected.

Protection for Minors with Substantial Assets

Minors who possess significant assets, such as inheritances or trust funds, may require a guardian to oversee and manage their financial affairs until they reach adulthood. This ensures that their assets are properly protected and utilized for their long-term benefit.

Safeguarding Individuals with Intellectual or Developmental Disabilities

Individuals with intellectual or developmental disabilities may benefit from a guardian who can provide ongoing support, make decisions related to healthcare and living arrangements, and advocate for their rights. A guardian can help ensure that their specific needs are met and that they receive the care and assistance necessary for their well-being.

Preserving Eligibility for Government Assistance

In some cases, individuals may require a guardian to help protect their eligibility for government assistance programs. By properly managing their finances and assets, a guardian can ensure that the person continues to qualify for essential benefits while receiving the necessary support and care.

How does the guardian Advocacy process work for adults with special needs?

Guardian Advocacy is a legal process where a court appoints a guardian advocate to make decisions for a person with disabilities. Florida recommends guardian advocacy over guardianship when the person's disability began before the age of 18. This allows a Guardian Advocate to protect the Ward's health and living interests.

Selecting a Guardian

The court assumes the responsibility of selecting a guardian and ensuring the well-being of the person under guardianship, whether it's a minor with managed assets or an adult with a disability.

The legal provisions outlined in Chapter 744 of the Florida Statutes, along with the Probate Rules, govern the process and establish the duties and responsibilities of guardians, attorneys, and the court.

Responsibilities of a Guardian

Managing Finances

A guardian is entrusted with the responsibility of managing the person's assets, financial obligations, and making informed choices on their behalf. This includes handling financial transactions, paying bills, and ensuring the person's financial well-being.

Medical Decision-Making

It is crucial for a guardian to involve the person in discussions about medical decisions whenever possible or make decisions directly on their behalf, taking into consideration their best interests and preferences. The guardian acts as an advocate for their healthcare needs and ensures they receive appropriate medical care.

Daily Life Support

A guardian plays a vital role in coordinating daily activities, arranging suitable housing, and facilitating the person's active participation in community life. They provide the necessary support to help the person live a fulfilling and independent life to the best of their abilities

Education and Benefits

If the person in need of a guardian is a child with special needs, the guardian may need to ensure they receive a suitable education. Additionally, the guardian may assist in advocating for public benefits that the person is entitled to, ensuring they receive the necessary support and resources.
