Trust Administration

Trust Administration is the process in which a Trustee, designated by a Trust document, carries out their responsibilities and duties as Trustee under Florida Law and the Trust document.

 

Florida Law assigns the Trustee specific responsibilities because the Trustee is entrusted to safeguard Trust assets on behalf of the beneficiaries. 

Florida trust laws state that a trust is created only if: The settlor has capacity to create a trust. The settlor indicates an intent to create the trust. The trust has a definite beneficiary or is a charitable trust, a trust for the care of an animal, or a trust for a noncharitable purpose.

In Florida, the duration of probate depends on the type of probate required and the complexities of the assets and debts of the estate.

 

Formal Administration may take between three (3) and nine (9) months. Summary Administration may take between one (1) and four (4) months.

steps to florida probate and how we can help:

Review decedent's estate planning documents 

It is important to gather the decedent's estate planning documents. The original Last Will and Testament must be deposited with the Court.

Order multiple copies of the death certificate

Throughout the probate administration, any number of institutions, including Court, may request or require an official death certificate to access financial accounts, life insurance policies, and more. 

Petition for Administration and Notice to the Beneficiaries

One of the most important steps of the probate process is to begin it by filing a Petition for Administration with the Court. This notifies the Court that we have begun administration of someone's estate.

Then, we must notify all known beneficiaries of the Petition for Administration. This allows beneficiaries an opportunity to object to the Petition for Administration. 

Gather Assets, Pay Debts, Distribute the REmainder

With our help, you will gather the assets of the decedent and file a formal inventory of the estate with the Court. These assets are used to pay outstanding debts before distributing the remainder to the beneficiaries. 

 

In most cases, a decedent passes with some debts. This may include the funeral home, final medical costs, credit card debt, and more. We notify known and potential creditors over a ninety (90) day statutory period. 

 

Any remaining assets are then distributed to the beneficiaries.

The final step of probate is to file a Formal Discharge with the Court. This releases the Personal Representative administering the estate of the decedent of their formal responsibilities. 

Trust administration

Obligations when a success or trustee is appointed 

Trust administration involves handling and managing the assets designated as Trust property. A Successor Trustee is required to complete additional steps when newly appointed to the position of Trustee.

Manage trust assets

  • A trustee must gather and account for Trust assets. It is the Trustee's responsibility to ensure the Trust assets are protected. 

Notify beneficiaries of changes to the trust

  • As Trustee, you are obligated to give notice to beneficiaries of changes to the Trust. 

Accountings to the beneficiary

  • The Trustee owes a duty to the beneficiaries to inform and account for Trust assets. A formal accounting of the Trust must be given to a beneficiary upon reasonable request. 

 

Follow Florida Law

  • Florida Statute, Chapter 736, states the duties and obligations of a Trustee.

The responsibilities of a trustee include managing and safeguarding trust assets, distributing income and principal to beneficiaries, maintaining accurate records, filing tax returns, and acting in the best interests of the beneficiaries.
